The Rule of Law

  • 11 November 2008

During the swearing in ceremony of a judge to the Higher Federal Court day before yesterday, The President, His Highness Sheikh Khalifa bin Zayed Al Nahyan, affirmed two main principles of the UAE's domestic policy: the right to justice for all, and the rule of law above all else. These principles encapsulate the vision of the UAE leadership for the important role played by justice in society, and how justice serves as a basis for stability and development. It also highlights the point that law is the main basis in the country for forging relationships, interactions and transaction and that no one is above the law, regardless of the position or office he or she may hold.

The sovereignty of law in the United Arab Emirates finds its basis in the Constitution which states that all people are equal before the law and will not be discriminated against on the basis of their race, ancestry, color, religion, and social status. These affirmations are translated into practice which confirms that the UAE favors the rule of law and stands determined to consolidating its reputation by making law the main guarantor for maintaining security and rights of people and properties. Undoubtedly, the respect and sovereignty of the law in the country has put an end to the fraudulent practices and has restricted the menace of corruption because everyone is aware of his or her rights as well as of the threat of being punished in case anyone commits a transgression or hurts the interest of society. Societies suffering from a weak implementation of law suffer from corruption and are threatened by disintegration because no development can take place in a country, in case its law is not properly enforced.

The sovereignty of law does not just provide stability to the UAE society and the safety of relationship among its residents, but also serves as a catalyst for its comprehensive development for it provides a conducive atmosphere for economic growth at the  internal or external levels. In addition to promoting security and political stability it supports a free economy, trade and culture, as the rule of law is seen as a vital prerequisite by business establishments and companies for setting up enterprises because such ventures seek assurance that their efforts, interests and investments would be safeguarded by law.

The development of the UAE is a comprehensive endeavor and respect for law lies at its heart. This has always driven the UAE forward and made it a model for emulation at both regional and international levels, in addition to improving the image of the country abroad and making it a suitable destination for tourists, intellectuals, writes and businessmen who find an ideal environment for life and work on the basis of law which covers everyone without exception and without discrimination for any reason.
